The terms and conditions listed below apply to all purchases of products in the online shop at www.OBAKU.com belonging to Obaku, LLC, P.O. Box 49185, Charlotte, NC 28277. These Terms and Conditions and any purchase agreement entered into on the site are subject to United States law.

By placing an order, the customer accepts these Terms and Conditions, which will at all times be accessible in the Obaku online shop. Please read them thoroughly. We hope you enjoy using our online shop.

 

DESCRIPTION OF PRODUCTS
Obaku will take all reasonable care to ensure that all details, descriptions, images and prices of products appearing on the website are correct at the time when the relevant information was entered into the system. Although we aim to keep the website as up to date as possible, the information including Product Descriptions appearing on the website at a particular time may not always reflect the position exactly at the moment you place an order.

 

PLACE AN ORDER

Thank you for shopping in our online store. For your convenience, you may use one of the following methods to place an order with us:

Order Online from our online selection using a major credit card (Visa, MasterCard, Discover, American Express), ClearPay, ApplePay, or your PayPal® account. As you browse, just add your selections to the “cart”. When you are finished, click “cart” and proceed to Checkout. Order any item from our full collection by Phone Call our Customer Service Center at (704) 899-5250. You can place orders from 8:30 a.m to 5:00 p.m Eastern time from Monday to Friday. Please have your credit card number, expiration date, and item numbers ready when you call. Order in any of our store locations. Visit our Store Locator to find a store near you.


Orders placed after 11:00 am est using the free shipping method will be shipped out on the next business day. Orders placed after 3:00 pm est with express shipping will be shipped out on the next business day.

ONLINE PURCHASING PROCESS

Locate the product you wish to purchase. Place the product in the shopping cart by clicking "Add to Cart".After this, you have two options: you can either "continue shopping" or "Proceed to checkout". While in the online shop, you can see the contents of your shopping cart at any time by clicking "Cart" in the upper right corner of the site. You can remove items from the cart by clicking "Remove". If you want to change the quantity, edit the number in the "Item(S)" box. If you wish to add more items to your cart, click "Continue shopping". When you are ready to complete your purchase, click the button "Proceed to checkout".On the next page, you enter your billing address and select the payment method by clicking "Pay with my PayPal account". Also, enter the delivery address if this is different from the billing address. Finally, you can add a comment for Customer Service in "Note to seller". You are responsible and liable for ensuring that the entered customer information is correct, as Obaku will perform no further validation or control of this information. When you have finished entering your data, click "Pay" to complete your purchase. You can at all times see a summary of your order in the "Your order summary" box on the left side of the screen. If needed, you can edit the shipping and invoice addresses as well as the comment to Customer Service. Finally, you must accept our Terms and Conditions and then click "pay". When you click "Pay", you accept the payment obligation for your order. As soon as the purchase is completed, you will receive an Order Confirmation on the e-mail address you provided when placing your order. In case the desired product is not in stock at the time of order, we will contact you by e-mail to inform you of the expected delivery date.

 

PRICES AND PAYMENT
All prices are listed in USD (US dollar). 

The prices payable for watches on Obaku.com exclude shipping and sales tax, these will be payable by the customer.


We reserve the right to change our prices with immediate effect and without prior notice. 

The price applicable to your purchase is that which is listed on the website for the product in question at the time of the order.
Obaku accepts payment, through PayPal, with the following cards: VISA, MasterCard, American Express and Discover Card. When you place an order, the payment total will be reserved on your account, but the money will not be deducted from your account until we ship your order.

 

DELIVERY
Obaku will ship the goods via USPS (unless otherwise indicated) to a recipient within the United States. Delivery will be made to the delivery address provided by the customer. 

You can expect to receive your order within 6-9 business days when we have the item in stock. As Obaku cannot guarantee local delivery conditions, Obaku cannot provide a guaranteed delivery time at the customer/recipient's address. In case the desired product is not in stock at the time of order, we will contact you by e-mail to make arrangements and provide you with an estimated delivery date.

If your package is damaged upon arrival, we recommend that you make a note that you are receiving a damaged package when signing for the shipment.

When your order has been filled and shipped, you will receive an e-mail with the USPS tracking number, your PayPal Transaction ID, and your order number.

 

RIGHT OF WITHDRAWAL
If you choose to cancel a purchase, you must return the goods in the same condition and quantity as when you received them. As the packaging represents a part of the product value, the product cannot be considered returned in the same condition and quantity if the packaging is not included. You are liable for ensuring that the returned goods are packaged suitably. Thus, we encourage you to save the packaging until you are certain that you wish to keep the product. You are liable for any reduction in the value of the product arising from another handling than what is required to determine the nature and properties of the product and the way it works. Proof of purchase, such as a copy of the original Delivery Note is required for reimbursement of the full purchase price. In all cases, refunds will be made to the card used for the original payment. 


You must return the product(s) without undue delay and no later than 14 days from the date on which you informed us of your wish to withdraw.

Returning an item is free of charge and we will provide you with a return label. To get a return label, send an email to us@obaku.com.

When you cancel a purchase we will refund your payment to your account as soon as possible and no later than 30 days after we have received the returned product.

Refunds are transferred to the payment card with which the purchase was made.

Obaku Denmark's responsibility for errors in relation to delivery is limited to existing conditions of sale. Obaku Denmark bears no direct or indirect responsibility for example, but not limited to, delivery delays, downtime, data loss, additional work, or other economic harm.

 

FORCE MAJEURE 
Obaku Denmark will be exempt from liability for damages and other penalties on the performance of the contract prevented, hindered, or delayed by circumstances beyond our control. As the release factor should be considered include government intervention, new/amended legislation, lack of state, war, fire, flood, labor disturbance, prohibitions, restrictions, sabotage, poor transport or weather conditions, or lack of delivery from suppliers and the company is exposed to criminal activity that affects activities.

 

RETENTION OF PROPERTY
All products remain in Obaku Denmark property until full payment is made.

 

FRAUD
All attempts of fraud are reported to the police and Obaku Denmark reserves the right to cancel the purchase if any suspicion is raised. 

 

GOVERNING LAW AND JURISDICTION
These terms and the use of the www.obaku.com website are governed by USA law. To the extent permitted by law, USA courts shall have exclusive jurisdiction of any dispute arising from these terms of use and your use of the website, subject to the right of Obaku Denmark to prosecute a user at his/her place of residence.

DELIVERY
Obaku ships worldwide. Obaku will ship the goods via FedEx (unless otherwise indicated) to a recipient outside the Hong Kong SAR. For exceptions see FedEx shipping guide. Delivery will be made to the delivery address provided by the customer.

You can expect to receive your order within 3-7 business days, unless otherwise indicated, when we have the item in stock. As Obaku cannot guarantee local delivery conditions, Obaku cannot provide a guaranteed delivery time at the customer/recipient address. In case the desired product is not in stock at the time of ordering, we will contact you by e-mail to make arrangements and provide you with an estimated delivery date.

We insure all shipments against loss and damage while they are in transit from Obaku to the recipient address. As soon as the shipment has been signed for at the agreed address, the insurance will lapse. If your package is damaged upon arrival, we recommend that you make a note that you are receiving a damaged package when signing for the shipment.

When your order has been filled and shipped, you will receive an e-mail with a link to your shipment information on the FedEx website, your PayPal Transaction ID and your order number. For items not part of the free shipping offer you will receive a confirmation that the item was sent with your chosen shipping option.

RIGHT OF WITHDRAWAL
You have the right to cancel your purchase within 14 days without giving any reason. The right of withdrawal expires 14 days after receipt of goods.

To exercise your right of withdrawal, you must inform us unambiguously that you wish to withdraw, e.g. by letter or e-mail. Proof of purchase, such as a copy of the original delivery note, is required in order to reimburse the full purchase price. In all cases, unless otherwise agreed, refunds will be made to the card with which the purchase was made.

If you choose to return a purchase, you must return the item(s) in the same condition and quantity as when you received them. Packaging is part of the product’s value and a return is considered incomplete if it’s missing upon receipt. You are liable for ensuring that the return goods are packaged safely and securely with good amounts of cushioning to prevent any damage that might occur during shipping. Before returning your purchase, make certain the item has neither been sized nor worn. 

All returns must have the original, non-damaged packaging and all original documents (instruction manuals, warranty cards, hangtags, spare links, plastic protectors, etc.). If a returned item has any signs of wear a re-stocking fee of $15 (USD) will be applied when making the refund. If signs of wear are substantial, such as damaged elements on the watch, the item will be returned to you. You are liable for any product value reduction arising from improper handling. 

You must return the product(s) without delay and no later than 14 days from the date you informed us of your withdrawal.

When returning your purchase, you are liable and responsible to arrange and pay for the return shipment. In order to prevent loss or damage during shipping, remember to duly insure your return. Any purchases made in December will have the right of return until January 15th. Obaku will not be liable for any damaged or loss, which occurs during the return. 

When you cancel a purchase we will refund your payment to your account as soon as possible and no later than 30 days after we have received the returned product.

All refunds are transferred to the payment card with which the purchase was made. In case of pre-payment via bank transfer, the refund will be transferred back to the account from which the payment was made.

 

All product returns must be sent to the address in their respective region.
